Раздел квартиры при разводе

Расторжение брака сопровождается разделом недвижимого имущества. Если речь идет о квартире, которая признана общей совместной собственностью, то она подлежит разделу, и неважно, на чье имя она оформлена.

Обычно суд определяет равные доли супругов в квартире, но бывают случаи, когда их уменьшают или увеличивают, например, в интересах ребенка. Раздел приватизированной квартиры

Особенность раздела приватизированного жилья в том, что его собственником является только один супруг (если он до брака получил эту квартиру в наследство или дар), а второй там только прописан.

Причем последний обычно уверен, что ему тоже полагается доля в квартире при разводе.

Но Жилищный кодексе РФ гласит, что при разводе с собственником жилья второй супруг теряет право пользования жилым помещением.

Однако суд может сохранить за ним право пользования квартирой после развода на определенный срок, а также обязать собственника обеспечить жильем тех членов семьи, которым он выплачивает алименты. Обычно это ребенок или бывший супруг.

Бывает, что приватизированную квартиру муж и жена поделили на доли в ходе  приватизации (если каждый имел право на приватизацию и является собственником своей части). Тогда делить ее при разводе не нужно.

Раздел неприватизированного жилья

В законе четко оговорено, то муниципальная собственность разделу не подлежит. Супруги должны переоформить договор социального найма. Статья ст. 69 ч. 4 Жилищного кодекса РФ буквально гласит, что если гражданин перестал быть членом семьи нанимателя жилого помещения по договору соцнайма, но продолжает проживать в этой квартире, то за ним сохраняются такие же права, какие имеют наниматель и его семья. Бывший супруг самостоятельно отвечает по своим обязательствам по этому договору.

Таким образом, оба супруга имеют равные права на муниципальное жилье.
